How We Handle Data Protection Complaints

We aim to handle data-protection complaints fairly, thoroughly and without unnecessary delay.

Acknowledgement

We will acknowledge receipt of your data-protection complaint within 30 days of receiving it and confirm that we will review the matter.

Investigation

We will take appropriate steps to investigate the complaint, including reviewing relevant records, communications and other information and, where necessary, speaking with relevant members of staff.

Additional Information

We may contact you if we need further information, clarification, proof of identity or evidence that you are authorised to act on behalf of another person.

Keeping You Informed

Where appropriate, we will keep you informed about the progress of the complaint, particularly where additional time is needed to complete our enquiries.

Outcome

Once our investigation is complete, we will explain the outcome of the complaint and, where appropriate, any action we have taken or intend to take.

Please note: The 30-day requirement relates to acknowledging receipt of the complaint. Some investigations may require additional time depending on the circumstances and complexity of the issues raised.

Possible Outcomes and Corrective Action

After completing our investigation, we will explain the outcome of the complaint and, where appropriate, any action we have taken or intend to take.

No Further Action Required

We may conclude that the personal information was handled appropriately and that no corrective action is required.

Correction of Information

Where personal information is inaccurate or incomplete, we may correct or update the relevant records where appropriate.

Changes to Processing

We may change how personal information is collected, used, stored, shared or retained where our review identifies that an improvement is needed.

Restriction, Deletion or Other Action

Where appropriate and legally permissible, action may include restricting certain processing, deleting information or changing access to particular records.

Improvement to Procedures

We may update internal procedures, guidance, staff instructions or technical measures where the complaint identifies an opportunity to improve our data-protection practices.

Explanation or Clarification

In some cases, the appropriate outcome may be to explain why the information was handled in a particular way and why we consider that handling to have complied with applicable data-protection requirements.

Outcome decisions depend on the circumstances: Not every complaint will result in corrective action. We will explain our reasoning and any action taken where appropriate.

If You Remain Dissatisfied

If you remain dissatisfied after Carol’s Law has considered your data-protection complaint, you have the right to raise the matter with the Information Commissioner’s Office (ICO), the UK regulator for data protection.

Contacting the ICO

The ICO can consider concerns about how personal information has been handled and may ask Carol’s Law for information about the complaint and how it was investigated.

Other Rights

You may also have other legal rights or remedies available to you. Nothing in Carol’s Law’s complaints process prevents you from exercising rights available under applicable law.

Before contacting the ICO: It is usually helpful to keep copies of your complaint, Carol’s Law’s response and any relevant correspondence or supporting information.

Complaint Records, Learning and Final Information

Carol’s Law may keep appropriate records of data-protection complaints, investigations, correspondence, outcomes and any corrective action taken.

Complaint Records

Records may include the complaint received, relevant communications, evidence reviewed, decisions made, the response provided and any follow-up action.

Confidentiality

Information relating to a data-protection complaint will be handled carefully and in accordance with our Privacy Notice, confidentiality procedures and applicable data-protection requirements.

Learning and Improvement

We may use complaint outcomes to identify opportunities to improve our data-protection procedures, staff guidance, systems or information-handling practices.

Changes to This Process

We may update this Data Protection Complaints process from time to time to reflect changes in our procedures, services or applicable legal requirements.
