Confidentiality & Information Sharing

Last updated: September 25, 2026

Carol’s Law Ltd handles personal and sensitive information carefully and aims to respect confidentiality throughout its work with families, professionals and services.

Confidentiality is important, but it is not absolute. There may be circumstances where relevant information needs to be shared where this is lawful, necessary and appropriate.

Our Approach to Confidentiality

We aim to handle information in a way that is proportionate to the purpose for which it was provided and consistent with our data-protection, safeguarding and information-sharing responsibilities.

  • We collect and use information only where relevant to the support being provided.

  • We aim to limit access to information to those who need it for an appropriate purpose.

  • We aim to share only the information reasonably necessary for the relevant purpose.

  • We distinguish, where appropriate, between family-reported information, supporting documents and professional information.

  • We keep records of relevant decisions and information-sharing activity where appropriate.

Important: Carol’s Law cannot promise that information will never be shared. Information may need to be disclosed where this is lawful, necessary and appropriate for safeguarding, serious safety concerns, legal obligations or other legitimate purposes.

When Information May Be Shared

Carol’s Law may share personal information where this is lawful, relevant and appropriate to the purpose concerned. Before sharing information, we consider the circumstances, the reason for sharing and whether the amount of information disclosed is proportionate.

With Your Authority

Where appropriate, we may share relevant information with professionals, services or organisations when you have authorised us to do so as part of the agreed support.

To Provide the Agreed Service

Information may be shared where this is necessary and appropriate to carry out the advocacy, referral, communication or follow-up support that has been agreed.

Safeguarding Concerns

Information may be shared where this is necessary and appropriate to carry out the advocacy, referral, communication or follow-up support that has been agreed.

Serious or Immediate Safety Concerns

In an urgent or emergency situation, relevant information may be shared where necessary and proportionate to help protect someone from serious harm.

Legal or Regulatory Requirements

Information may be disclosed where Carol’s Law is required or permitted to do so by applicable law, court order, regulatory requirement or other lawful authority.

Professional or Operational Support

Where necessary, limited information may be shared with appropriate professional advisers or service providers who support the operation of Carol’s Law, subject to appropriate confidentiality and data-protection arrangements.

Minimum Necessary Information

Where information is shared, we aim to disclose only the information reasonably necessary for the relevant purpose and to avoid sharing unrelated or excessive information.

Information is not shared automatically: Each situation should be considered on its own facts, including the purpose, risks, legal basis and amount of information required.

Sharing Information Without Consent

There may be circumstances where Carol’s Law needs to share relevant information without first obtaining the individual’s consent.

This would only be considered where there is an appropriate lawful basis and where sharing is necessary and proportionate to the circumstances.

Safeguarding Concerns

Information may be shared without consent where this is necessary and appropriate to respond to a serious safeguarding concern.

Serious Risk of Harm

Information may be shared where there is a serious or immediate risk to someone’s safety or life and disclosure is necessary to help protect them.

Legal Requirement or Lawful Authority

Information may be disclosed where Carol’s Law is required or permitted to do so by law, court order or another lawful authority.

Where Seeking Consent May Increase Risk

In some circumstances, asking for consent before sharing information may not be appropriate, for example where doing so could increase risk, prejudice safeguarding action or otherwise undermine the purpose of the disclosure.

Where Seeking Consent May Increase Risk

Where information is considered for sharing without consent, Carol’s Law may consider factors such as:

  • the seriousness and immediacy of the concern

  • who may be at risk

  • the purpose of the proposed disclosure

  • whether the disclosure is lawful

  • whether the information is relevant and necessary

  • whether less information could achieve the same purpose

  • whether seeking consent would be appropriate in the circumstances

Sharing without consent is not automatic: Decisions are considered on the facts of the individual situation and should be limited to what is lawful, necessary and proportionate.

How We Record and Review Information Sharing Decisions

Carol’s Law may keep appropriate records of significant information-sharing decisions to support accountability, continuity and good information governance.

Recording the Decision

Where appropriate, we may record what information was shared, who it was shared with, the purpose of the disclosure and the reason the sharing was considered necessary.

Recording the Basis for Sharing

We may record the relevant consent, authority, safeguarding concern, legal basis or other justification relied upon for the disclosure.

Limiting the Information Shared

Where possible, we aim to record why the information shared was considered relevant and proportionate to the purpose concerned.

Reviewing Decisions

Information-sharing decisions may be reviewed where circumstances change, new information becomes available or further action is required.

Correcting or Updating Information

Where we become aware that information previously shared was materially inaccurate or incomplete, we may consider whether an appropriate correction or update should be provided to the relevant recipient.

Accountability: Keeping a clear record of significant information-sharing decisions helps explain what was shared, why it was shared and what action was taken.
